1. Acceptance of Terms

By accessing or using Echo Route's services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Echo Route provides an AI-powered phone answering service that handles incoming calls for businesses. The Service includes call answering, lead capture, appointment scheduling, voicemail transcription, and related notifications via SMS and email.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Use the Service to harass, abuse, or harm others
  • Transmit spam, chain letters, or unsolicited communications
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Use the Service to make or receive calls for telemarketing, debt collection, or other regulated activities without proper compliance

5. SMS Communications

By opting in to SMS notifications during account registration, you consent to receive automated text messages from Echo Route related to your phone answering service, including missed call alerts, voicemail notifications, new lead alerts, appointment confirmations, daily summary reports, and account updates.

Message frequency varies based on your call volume and notification preferences. Typical usage ranges from 1 to 10 messages per day depending on your incoming call activity. Message and data rates may apply.

Echo Route will never share your opt-in consent or phone number with third parties for promotional purposes. By opting in, you confirm that you are the account holder or an authorized representative and that the phone number provided is your own.

6. Phone Numbers

Phone numbers provided through the Service remain the property of Echo Route or our telephony providers. Upon termination of your account, you may request to port your number to another provider, subject to applicable fees and carrier policies.

7. Call Recording and Transcription

The Service records and transcribes calls handled on your behalf. You are responsible for complying with all applicable laws regarding call recording, including obtaining any required consent from callers. Many jurisdictions require disclosure that calls may be recorded.

8. Payment Terms

Subscription fees are billed in advance on a monthly basis. Usage-based charges (such as per-minute fees) are billed in arrears. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

9. Free Trials

We may offer free trials at our discretion. At the end of a trial period, your account will be converted to a paid subscription unless you cancel. Trial terms may be modified or discontinued at any time.

10. Intellectual Property

The Service, including its design, features, and content, is owned by Echo Route and protected by intellectual property laws. You retain ownership of your business information and call data, and grant us a license to use this information to provide the Service.

11. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

12. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service at any time. We are not liable for any modification, suspension, or discontinuation of the Service.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO ROUTE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Echo Route and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

15. Termination

You may cancel your account at any time through your account settings or by contacting support. We may terminate or suspend your account for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Service ceases immediately.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Echo Route regarding the Service.
